Opis predavanja

Objasnićemo na koje aktivnosti programera i administratora u Srbiji se GDPR, kao pravni dokument Evropske unije, potencijalno primenjuje. Na primerima ćemo prikazati one principe dopuštene obrade podataka o ličnosti koji su od naročitog značaja za IT sektor: zakonitost i transparentnost; ograničenje u odnosu na svrhu obrade; minimizacija podataka;  ograničenje perioda čuvanja; i integritet i poverljivost.

Navedeni principi predstavljaju u praksi izazov za IT sektor:

  • pristanak (kao osnov za zakonitost obrade): informisan, slobodno dat, uopšte dat?;
  • određenost svrhe (kod Big Data);
  • minimizacija podataka (kod IoT i Big Data);
  • bezbednosne mere - posledice nepreduzimanja odgovarajućih mera (Rousseau odluka italijanskog Garante-a, april 2019).

Evropski odbor za zaštitu podataka o ličnosti je dao smernice o tome kada korišćenje novih tehnologija, praćenje ponašanja fizičkog lica i njegove lokacije, profilisanje lica u velikom obimu, i obrada korišćenjem uređaja sa senzorima obavezuje potrebu sprovođenja data protection impact assessment-a.

Ukazaćemo na dilemu vezanu za cloud computing: ako podaci odlaze i u države izvan EU, da li je korišćenje cloud-a dopušteno? 

Bogdan is the leader of the firm’s intellectual property practice since 2012. He also heads the firm’s media & entertainment and life sciences sectors and leads data protection & privacy team.

Bogdan has a specialisation in intellectual property law from the American University, Washington College of Law, and an LLM in International Legal Studies from the same university. He obtained his LLB at the University of Belgrade Faculty of Law.

He is founder, editor and major contributor to BDK’s intellectual property and data protection blogs. He has also contributed to leading intellectual property law blogs and magazines, such as The IP Kat, the 1709 Blog and IPPro The Internet.

Prior to launching a career in intellectual property law, Bogdan spent 12 years working as a human rights researcher and lawyer for Human Rights Watch and the International Centre for Transitional Justice. He has maintained interest in criminal law and is involved in firm’s work in that area.

Bogdan is fluent in English and Italian, conversant in Spanish and reads French.

Milica Basta joined BDK’s data protection and privacy practice as consultant in June 2016. Previously, she worked in the Office of the Commissioner for Information of Public Importance and Personal Data Protection, first as a senior advisor for Normative Affairs and then as Head of the Department for Personal Data Protection. 

Milica obtained her L.L.B. and L.L.M. from the Belgrade University School of Law. She is certified trainer in the field of legislative process.

Prior to commencing career in the data protection law, Milica worked in several ministries where she dealt with normative and EU integration affairs. She taught EU law at a private university in Belgrade.

Milica is fluent in English, conversant in Russian and reads Italian and Spanish.
